EXCLUSIV – Angela Ciurea: „Laura Codruta Kovesi facea frecvent presiuni asupra mea in dosare!”
Ca si Ciprian Nastasiu, Angela Ciurea a fost procuror DIICOT, in perioada 1 august 2006 – 6 ianuarie 2009. A fost exclusa din magistratura pe 16 septembrie 2009, pe motiv ca s-ar fi vazut cu unul dintre inculpati dintr-un dosar pe care-l instrumenta, fara sa fie autorizata, insa, potrivit unor surse din Parchetul General, motivatia reala este aceea ca Angela Ciurea s-ar fi apropiat periculos de mult de dovezi privind implicarea unor nume sonore din politica romaneasca in traficul de armament si subminarea sigurantei nationale prin furnizarea de informatii economice catre persoane neautorizate.
In contextul dezvaluirilor facute de fostul sau coleg, Ciprian Nastasiu, Angela Ciurea lamureste, in exclusivitate pentru Q Magazine, aspecte importante privind sistemul anchetarii unor personalitati si presiunile la care sunt supusi procurorii.
Q Magazine: Fostul procuror Ciprian Nastasiu, astazi avocat, a dezvaluit ca in cadrul DIICOT se instrumentau dosare privind industria energetica a Romaniei, dosare in care apar numele unor politicieni si jurnalisti precum Verestoy Attila, Elena Udrea, Dorin Cocos, Dan Voiculescu, Bogdan Chireac. Ce stiti despre aceste dosare? In care ati lucrat si ce ati descoperit in cadrul cercetarilor?
Angela Ciurea: In cadrul DIICOT se instrumentau, intr-adevar, dosare de o complexitate deosebita in care, printre altele, existau si referiri la acesti politicieni. Nu va pot spune foarte multe detalii despre aceste dosare, in primul rand pentru ca eu doar coordonam ancheta in calitate de adjunct al DIICOT, la ordinul verbal al procurorului sef Olaru, si participam in sedintele de judecata, inclusiv cele referitoare la autorizari de interceptari sau perchezitii; in al doilea rand pentru ca mare parte din aceste acte nu stiu daca s-au declasificat. Vorbim aici despre Alro, Nuclearelectrica si celelalte disjungeri din asa numitul „dosar al privatizarilor strategice”, pentru ca, in ceea ce priveste traficul de armament sau dosarul fugii lui Omar Hayssam, acolo am lucrat efectiv ca si procuror de caz. Erau dosare care necesitau ani intregi de munca de investigatie, nu doar juridica, ci si informativa si in care, din pacate, serviciile specializate ne ofereau prea putin sprijin. As putea sa fac speculatii ca duc la anumite persoane, dar nu-mi permit sa fac afirmatii pe care, in acest moment, cand nu mai sunt procuror si nu mai posed certificat ORNISS, nu as mai putea sa le dovedesc. Un lucru este cert: toti procurorii care au lucrat in aceste dosare nu mai sunt azi procurori! Dintr-un motiv sau altul… Nu se poate ca unui simplu cetatean, fara cunostinte nemaipomenite, asta sa nu-i dea de gandit!
Pana la momentul la care am plecat din DIICOT, in dosarul de Armament se ajunsese in cateva puncte sensibile pentru societatea romaneasca, si ma voi opri aici, ca sa nu trec in domeniul clasificatelor. Sigur ca daca cineva ar avea forta necesara si rabdarea sa finalizeze aceste dosare, lumea politica romaneasca ar fi zguduita din temelii. Ce am descoperit? Cred ca foarte putin in comparatie cu ce este in realitate si ce s-ar mai putea descoperi pe acolo… Repet, astfel de dosare necesita ani intregi de munca pentru procurori si ofiteri de informatii.
Q: Ca procuror in cadrul DIICOT, s-au facut presiuni asupra dvs. in anumite dosare? Daca da, in ce fel si cine anume le-a exercitat?
A.C.: Presiunile care s-au facut asupra mea si a colegilor mei erau toate legate de aceste dosare si erau foarte greu de suportat. Actorii principali: Seful DIICOT si Procurorul General. Erau zile in care urcam si coboram scarile la Cabinet de zeci de ori, si nu ca sa fim felicitati. Problemele au aparut prima data in dosarul fugii, si s-au pus cu atata meschinarie incat nu merita reproduse. Ni se spunea permanent ca exista un singur mod de a pleca al lui Omar Hayssam, si anume, cu nava. Eu nu neg ca acesta ar putea fi adevarul, nu stiu, sa spuna instanta, dar niciodata nu am gasit raspunsul unor intrebari: de ce nu am fost lasati sa verificam si celelalte cai care mai apareau informativ in dosar? De ce, de cate ori aduceam vorba despre aceste lucruri, ni se spunea ca „alergam dupa cai verzi pe pereti”? Nu puteam efectua niciun act de urmarire penala fara sa informam conducerea. Mi se spunea sa nu-i mai permit domnului Nastasiu sa vada acte din dosar, desi Kovesi, la data investirii mele cu dosarul fugii, mi-a acceptat singura conditie pe care am pus-o, si anume ca domnul Nastasiu sa lucreze alaturi de mine in dosar. Am avut in vedere ca era un foarte bun anchetator si ca stia deja niste lucruri la care mie mi-ar fi fost greu sa ajung atat de repede. Cred ca tot asta aveau in vedere si cei doi superiori ai mei…
Ulterior, cand am refuzat sa solicit instantei arestarea unor persoane in acest dosar, a aparut in presa o nota clasificata care, chipurile, ar fi fost furnizata de unul dintre noi. Acesta a fost pretextul cu care am fost silita sa las dosarul unui alt coleg. Am semnat renuntarea cu mana mea si cu convingerea ca am atins oameni sau lucruri pe care nu aveam voie sa-i ating. Dar nu pot spune ca era vorba de X sau Y…
Pe dosarul de Armament ni se puneau bete in roate prin neimplicare. In opinia domnului sef Olaru, atat dosarul de Armament, cat si cel de spionaj erau „niste prostii”, iar DIICOT n-ar fi trebuit sa piarda timpul cu astfel de chestii care nu aduceau puncte la statistica. Aveam alta parere, asa ca eram deseori in divergente juridice. Comisiile rogatorii nu plecau: ba nu era traducator, ba nu erau complete, ba nu era de acord domnul Olaru cu ce scria in ele, s.a.m.d. Dupa revocarea domnului Nastasiu, ofiterii de politie au fost supraincarcati cu dosare si nu mai puteau sa faca acte in armament, iar audierile mi le faceam singura, dupa ora 16, fara grefier. Exceptie facea un singur comisar, care lucra de buna voie, cot la cot cu mine. Mi se atrasese atentia sa ma ocup de „protocolul” Directiei si de activitati de judiciar si sa predau dosarele altor colegi. Motivul: adjunctul DIICOT nu poate face dosare. Totusi, dosarul cu Floricel Achim a fost lucrat de adjunctul DIICOT.
In Alro si celelalte disjungeri, ni se spusese sa o luam mai usor, ca nu e graba, sa scoatem dosarele vechi mai intai si apoi acestea. Nu neg ca aveam si dosare mai vechi, volumul de lucru era fantastic, iar in dosarul de spionaj s-a lucrat la foc continuu, fara zi si noapte, fara Craciun sau Revelion. Unul dintre colegi spunea in gluma ca la pensie va scrie o carte despre noptile de veghe ale anchetatorului roman.
Cand am solicitat interceptarile cu pricina la ICCJ, doamna Kovesi mi-a reprosat ca ar fi trebuit sa informez in prealabil. Timp de 30 de zile, nu am primit nicio nota. Colegii mei, procurorii Nastasiu si Doru Cristescu, au solicitat listingurile la operatorii de telefonie mobila, in baza autorizatiei. Erau peste 1000 de convorbiri. Am solicitat la SRI lamuriri cu privire la modul de punere in executare a autorizatiilor si continutul catorva convorbiri care ne-au parut mai interesante prin persoanele intre care se purtau… Eu nu am vazut niciodata raspunsul, daca o fi existat vreunul.
Ar fi multe de spus aici, dar nu e loc si timp destul.
Q: V-a chemat vreodata fostul procuror general al Romaniei, Ilie Botos, sau actualul, Laura Codruta Kovesi, pentru a va sugera sau a va cere direct sa adoptati o anumita pozitie in anumite dosare? Daca da, va rog sa detaliati aceste imprejurari!
A.C.: Niciodata domnul Botos. Frecvent doamna Kovesi, asa cum am spus anterior.
Q: Ati fost exclusa din magistratura in urma unei sedinte a CSM la care nu ati participat si la care vi s-a imputat faptul ca v-ati intalnit cu Stamen Stantchev in strainatate, fara sa va informati superiorii. Stia sau nu stia cineva de aceasta intalnire si ce se ascunde, de fapt, in spatele excluderii dvs. si a discreditarii profesionale?
A.C.: Eram monitorizata din 1 iulie 2009 si nu spun pe vorbe aceste lucruri. Imi recunosteam filajele in trafic, pe unii ii mai vazusem in dosare. Eram in procedura de verificare ORNISS. Chiar credeti ca eram nebuna sa fac de capul meu aceste lucruri cand jumatate de servicii aveau asa misiune grea?! Dar asta se va lamuri la instanta, sper, cand se judeca recursul. Mi s-a cerut de catre doamna Kovesi sa-mi dau demisia si am facut-o. Motivul mi s-a parut intemeiat: nu aveam de ce sa tarasc DIICOT intr-un scandal de presa. Sigur ca asta a fost un pretext! Daca nu era asta, s-ar fi gasit altceva. Nu mai aveam incredere in nimeni. Eram epuizata fizic si nervos, as fi facut vreo greseala, cine stie?!
Q: Cunoasteti si alte dosare in care sunt implicati politicieni si oameni de afaceri? Care sunt acestea si cine sunt implicatii?
A.C.: Sigur ca sunt si alte dosare, dar de la implicare pana la dovedirea vinovatiei e cale lunga! Nu va pot da detalii.
Q: De ce credeti ca Ciprian Nastasiu nu a facut aceste dezvaluiri pana acum? Demersul lui, in campanie electorala, nu pare un atac premeditat impotriva lui Traian Basescu?
A.C.: Nu stiu de ce a ales acest moment. Nu am vorbit cu domnul Nastasiu de mai bine de un an. Nu-i cunosc evolutia de dupa revocarea din DIICOT. Mie mi se pare un moment ca oricare altul. Si apoi, daca vorbea inainte, ar fi ascultat cineva? Personal, as fi procedat in acelasi mod.
Q: Ati lucrat in dosarul Armamentul. Stiu ca ati avut o contributie importanta la prinderea lui Viktor Bout, traficant international de armament. Pana unde mergeau conexiunile acestuia in Romania?
A.C.: E adevarat, am lucrat cu fortele DEA in cazul Viktor Bout. A fost capturat cu ajutorul interceparilor solicitate de noi Curtii de Apel. Si acolo, ca si in restul cazurilor mari, am lucrat cu ofiterii de la frontiera, profesionisti impecabili. Cam doua luni, cred. Conexiunile? Mari, in institutii si in politica. Americanii au facut un rechizitoriu pana acum. In Romania se bate pasul pe loc.
Q: Va temeti pentru viata dvs.? Va simtiti amenintata?
A.C.: Daca ma tem pentru viata mea?! Nu suntem in Sicilia… sau asa cred! Nu ma tem de absolut nimic. Nici nu prea mai am ce pierde si nici nu am pe nimeni de protejat. De ce m-as teme?! Sunt un om care calatoreste mult. Monitorizarea mi-a conferit siguranta: pot merge noaptea singura pe strada, ca nu ma ataca nimeni!

Still, unexpectedly for me, Bout agreed to see me. I was invited to a crowded waiting hall. Every half-an-hour an attendant announces times for the meetings. Viktor Bout was brought into the meeting room .We started the conversation.

What happened in Thailand is a result of an old story .I was a translator. I accompanied firm’s representatives on firm’s business. In the late 1991 I decided to leave and to start my own business. I decided to become an air shipping broker.
Mostly it was charter flights. ………….We did hundreds flights under a contract …………………….Also did some shipping from Romania to Angola, for the Angolan government, also flew from Bulgaria.
How many airplanes did you have?
Is nonsense to say that I had 60 airplanes.
In good times I had up to 21 aircraft including An-28 and helicopters.
What assignments did you have?
We had many orders. For instance, we had the lawful government of Afghanistan as our customer – before Taliban We had contracts with the Congolese government, shipped goods from East Europe for them. They had their own Il-76, we did the maintenance and provided the crew. We had orders from Angola, Luanda governments. We actively worked with the Libyans, we provided airplanes to them, repaired some equipment.
What orders,you had from the Angolan government?
For instance we e did flights from Kurgan to Luanda, , from Bucharest, from Burgos for the Luanda government.
So, you are saying you did nothing unlawful?
I was just doing my job. I wasn’t interested what I am shipping and for what. I got orders and processed everything legally. If there are any problems about the items, then why don’t they get those who ordered them and who supplied them? For instance Romarm etc Nobody has any problem with senders and recipients; they are all just pointing at me.
Did you ship weapons? Were those shipments legal?
Legal, of course.I am a shipper. I get an order, I get paid. I send a request, get an approval, instruct my crew, the crew comes in, loads the aircraft, gets the shipping papers, clears customs. All these tales about illegal flights are not supported with anything. I am sorry, everyone in the transport business ships weapons if it is not an illegal cargo, if the papers meet all regulations. We had contracts with Russians and Romanians, companies. We did more than 100 flights under a contract with the Angolan government.

In August 1995, Hussein Kamel, son-in-law to Iraqi President Saddam Hussein, defected from Iraq and alerted UN Special Commission on Iraq (UNSCOM) that secret documents were hidden at a Baghdad chicken farm. One of the documents stated that after the 1991 Gulf War, Iraq sough to build a longer-range ballistic missile from the short-range al Samoud missile. To achieve longer ranges, the missile needed increased fuel capacity and a more sophisticated guidance system.
According to the “chicken farm documents,” in March 1995, Iraq secretly ordered advanced missile guidance systems that the Romanian company Aerofina agreed to sell. It was at this point that UNSCOM, realizing it needed help to find “concrete proof,” consulted an Israeli intelligence agency known as Task Force Green, headed by General Yaahov Amidor. “Operation Teacup” was approved by former UNSCOM Executive Chairman Rolf Ekeus and UNSCOM officials, working with Israeli intelligence, began to track down information about the gyroscope purchase. Within two months of the creation of “Operation Teacup,” former UNSCOM inspector Scott Ritter, acting on a tip from Israeli intelligence, intercepted gyroscopes with “Cyrillic markings” in Jordan bound for Iraq. Of the 60 ordered gyroscopes, 30 were intercepted by UNSCOM and 30 are still unaccounted for.
The Romanian government was informed of the chicken farm document as well as intelligence surfacing about the March 1995 gyroscope purchase. UNSCOM learned that Iraq had proposed more shipments of missile technology from Romania. UNSCOM chairman Richard Butler approved a new Operation Teacup, which would involve Israeli and US. he Romanian Foreign Ministry denied the allegations, stating that “Romania strictly respects the relevant arms embargo resolutions by the United Nations Security Council against Iraq and is dedicated to prevent any attempt to violate the resolutions.”[1] The Romanian Foreign Ministry also denied any knowledge of a visit by Iraqi officials in May 19998 to try to buy missile guidance systems.[2] The manager of Aerofina SA, also denied that the company ever negotiated with Iraq to deliver missile technology.[3]
Said Ritter, “We caught them red-handed.” According to Ritter, the evidence from this surveillance was never made public as it would have “torn down all the foundations of support that had been build by Iraq with the Security Council…” and “…exposed and put at risk capabilities which governments did not want to put at risk.”
Said Ritter, “We had the proof. We couldn’t present it.”

Report: Iraq sought prohibited weaponry
Despite years of claims it has ended all programs to build weapons of mass destruction, Iraq made a bid to acquire prohibited missile technology last May, CNN reported Sunday.
In its program NewsStand, produced with Time magazine, CNN said Iraqi missile experts, escorted by Iraqi secret police, went to the Romanian capital Bucharest to negotiate the purchase of guidance equipment for long-range missiles.
Iraq is required to eliminate its long-range missiles and chemical, biological and nuclear weapons under resolutions by the U.N. Security Council adopted after the 1991 Gulf War that ended Iraq’s occupation of Kuwait.
The CNN report quoted unnamed sources and Scott Ritter, an American ex-Marine who resigned as a U.N. arms inspector in August who complained the U.S. government was undermining the search for Iraq’s forbidden weapons.
Iraq has insisted since the early 1990s that it has destroyed all its prohibited weapons. Tough U.N. trade sanctions, imposed after Iraq’s 1990 invasion of Kuwait, cannot be lifted until U.N. inspectors certify that its weaponry has been destroyed.
According to the program’s transcript, the Iraqi purchase in Bucharest was blocked because spy agencies from the United States, Romania and Israel uncovered the potential deal and monitored the Iraqis’ two-week visit.
”We had the goods on the Iraqis. … We caught them red-handed,” Ritter told NewsStand.
Ritter, who earlier had disclosed U.N. arms inspectors’ dealings with Israel’s Mossad spy agency and the CIA, expressed disappointment the Romanian operation had remained secret.
”We could not present to the Security Council the most compelling evidence” of Iraqi non-compliance with U.N. resolutions, Ritter said.
He said revealing the information would have opened up ”the sources and methods used to collect it … which governments did not want to put at risk.”
According to NewsStand, agents learned of the plans for the Romanian visit from an Iraqi engineer who defected. They also had documents found at the farm of Lt. Gen. Hussein Kamel al-Majid, Iraqi leader Saddam Hussein’s son-in-law.
Iraq allowed inspection of al-Majid’s chicken farm after he defected in 1995; he later returned to Iraq and was killed. Among the documents from his farm was a previous contract for missile equipment with the state-run Romanian company Aerofina.

According to a high-level official of the former Iraqi regime, trade between Iraq and Romania flourished during the Ceauscescu era (1965 to 989). The IIS had an active presence in Romania throughout this period and MIC engineers were active in procurement programs directed from the Iraqi Embassy in Bucharest.
• In the mid-1990s, reporting indicated that the Iraqi MFA and MIC were both interested in changes to Romanian export controls over nuclear, biological, and chemical weapons and their associated technologies.
According to documents identified by UNSCOM in Operation Tea Cup, Iraq reestablished a procurement relationship with the Romanian firm Aerofina in February 1994. The Iraqis and Romanians conducted two to three delegation visits between Bucharest and Baghdad to discuss sending Romanian missile experts to Iraq to assist with design and guidance control problems in the Al Fat’h missile, later called the al Samud, and to obtain missile parts and related raw materials.
• By August 1994, several procurement contracts had reportedly been signed.
• In November 1995, the Iraqi’s sent a letter to Aerofina requesting that the missile repair part shipments be temporarily stopped due to concerns over the quality of the goods.
• As a result of UNSCOM’s operation (see inset), the Romanian Government acknowledged in 1998 that Aerofina sold Iraq weapons parts in 1994 via an intermediary company in Jordan.
According to a source with good access, a Romanian source provided analytical equipment and testing for SG-4 tank gyroscopes and gyroscopes intended for missile applications to Iraq in the late 1990s. This equipment may have been used to ascertain the quality of illicitly imported gyroscopes because Iraq could not manufacture them domestically. The name of the Romanian supplier was not specified.
In March 1998, Iraqi intelligence conducted an operation to smuggle weapons and military equipment from Romania in violation of UN sanctions, according to a reliable source. Walid al-Rawi, an IIS agent stationed in Romania, was sending pictures of tanks and military equipment available for sale from Romania back to Baghdad. An Iraqi diplomatic pouch was used to transfer the photographs. There is no further information concerning the type, number, or source of the conventional military goods purchased.
• Al-Rawi used Qatar and Dubai in the United Arab Emirates (UAE) as transshipment points for the illicit goods. Bribes were used to circumvent customs inspections at ports.
Al-Rawi obtained financing for the military goods by requesting money from Baghdad. If approved, the cash was reportedly sent to Romania via Geneva.

According to captured documents, Romania’s Uzinexport SA was contracting in October 2001 to provide Iraq withequipment, machinery and materials linked to a magnet production line for an Iraqi V-belt drive project. This company worked with a mix of Iraqi front companies and intermediaries that were representing the MIC, the Iraqi lead for the project. The magnets—assembled by the Iraqis with Romanian help—could have been suitable for systems used to spin gas centrifuge rotors for the enrichment of uranium. Although there is no evidence that the magnets were employed in the production of gas centrifuges, the capability to indigenously produce magnets would have allowed Iraq to maintain knowledge and skill-sets in this area.
The various front companies and trade intermediaries involved in the project included the Jordanian branch of the Iraqi firm Al-Sirat, the Jaber Ibn Hayan General Company, the Aa’ly El-Phrates company, and the Ali Al-Furat Trading Company. Jordan may have been used as a transshipment point for the magnet technology.
Captured documents indicate that the total sum of the contract awarded to Uzinexport for the V-belt project was $4,607,546. This was paid though a combination of cash, letters of credit, oil, and raw materials.
